WOTUS Rule Update

The latest chapter in the ongoing saga of defining “waters of the United States” (WOTUS) has come in a September 8th rule published by the U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers (the agencies). This most recent rule revises the definition in the agencies’ January 2023 WOTUS Rule and sets a higher standard to include adjacent wetlands under the jurisdiction of the Clean Water Act (CWA). As stakeholders have already raised questions about the rule, we anticipate there will be rule challenges.

As such, the following letter is being distributed to clients that provide public drinking water services to advise that 3M and DuPont, chemical and manufacturing companies, have reached potential Settlement Agreements in the federal product liability class action lawsuit MDL No. 2:18-mm-2873-RMG involving thousands of Public Water Systems (PWS) across the country. The potential settlements involve billions of dollars to be paid out to eligible claimants. Notices from 3M and DuPont are currently being mailed to potential claimants. If you have received a Notice from 3M and/or DuPont of the potential Settlement Agreements, then you may qualify to submit a claim and recover money from the settlement funds.

LLW Expands Its Environmental and Land Use Law Practice in Florida With Two New Hires

Katherine Hupp has joined the firm as an associate in its West Palm Beach office. After previously serving as a law clerk in LLW’s Tallahassee office, Katherine obtained the role of Assistant General Counsel at the St. Johns River Water Management District where she supported District staff by providing legal advice regarding the interpretation and application of relevant law and policy to the District’s permitting, water supply planning, and regulatory enforcement programs.

Prior to that, she was a City Planner for the City of Jacksonville, and served her community as Committee Member for the City of Jacksonville’s United Way Campaign.
