ACUS Announces New Council on Federal Agency Adjudication 

Washington, D.C., September 10, 2020 – The Administrative Conference of the United States (ACUS) is pleased to announce the establishment of the Council on Federal Agency Adjudication. 

The Council will provide a forum for the heads of agency adjudication programs to exchange information about procedural innovations, best management practices, and other subjects of mutual interest. It will also offer a forum for identifying subjects appropriate for ACUS study. 

Serving as the Council’s co-chairs are Acting ACUS Chairman Matthew L. Wiener; former ACUS Chair and Senior Fellow Paul R. Verkuil; and Nadine N. Mancini, who chairs ACUS’s Committee on Adjudication. Ms. Mancini is General Counsel of the Occupational Safety and Health Review Commission.  

A consultative group of leading administrative law scholars will assist the Council by sharing academic research and helping to identify subjects for further study. 

ACUS has been at the forefront of efforts to promote fair, accurate, and efficient adjudication across the federal government. In the past decade, ACUS has issued recommendations on adjudicative best practices ranging from recusal rules to electronic case management; cataloged adjudication programs across the federal government; commissioned a groundbreaking study of Evidentiary Hearings Outside the Administrative Procedure Act; and published revised Model Adjudication Rules and Model Rules for Implementation of the Equal Access to Justice Act.  

Recent initiatives include a webpage to help agency adjudication offices navigate operational challenges posed by the COVID-19 pandemic; a recent virtual Symposium on Federal Agency Adjudication; and upcoming projects on agency appellate systems, alternative dispute resolution, and agency head enforcement and adjudication functions.
