What is a Personal Injury?

A Personal Injury or “PI” can stem from a motor vehicle accident, bicycle accident, a slip or trip and fall, assault and battery, emotional distress or even a dog bite. Essentially, it is an injury to you caused by someone or something else. The most common PI cases are motor vehicle accidents.

What kind of damages can I recuperate?

You may recover economic damages (i.e. medical bills, lost wages, and any other out-of-pocket cost) and non-economic damages (pain and suffering, loss of enjoyment in life, loss of consortium). Note, damages are a tax free occurrence.

Who do I recover these damages from?

Typically, there will be a motor vehicle policy, homeowners insurance policy or some type of other liability insurance that will cover the at-fault part and your damages. You can also pursue liability against the at-fault party if they have assets.

How long do I have after an incident happens to file a lawsuit?

Most personal injury cases have to be filed in the appropriate court within two years of the incident. However, motor vehicle accidents have a statute of limitations date of three years in Colorado.
