Wyoming House Passes Bill Banning Abortions, Affirming Life Begins at Conception

The Wyoming House has approved a bill to ban abortions should state courts ultimately overturn the current abortion ban.

Wyoming was supposed to become one of the states to protect babies from abortions after the Supreme Court overturned Roe. But a state judge blocked the pro-life law from taking effect.

Gov. Mark Gordon took necessary action to activate the state’s trigger law, enacted prior to the Supreme Court overturning Roe that would go into effect 30 days after any decision to overturn the infamous pro-abortion case. The new Wyoming abortion ban bans abortions except in cases of rape or incest or to protect the mother’s life.

Gordon signed the bill into law in March anticipating Roe would be reversed. After the June 24th decision, Attorney General Bridget Hill reviewed the law to ensure it conforms with the high court’s ruling and Hill completed her review.

But a court blocked the trigger law.

Now, a new ban the state House passed would go into effect if the court ultimately rejects the trigger law. Here’s more:

The Life Is A Human Right Act, House Bill 152, only can become law if the Wyoming Supreme Court declares its predecessor, the so-called abortion “trigger” ban, unconstitutional.

Rep. Barry Crago, R-Buffalo, brought the caveat amendment, which some called a “trigger on a trigger,” to an emotional House floor debate.

The Republican delegates for the amendment and those against it explained their votes by saying they want to speed up the ongoing court case challenging Wyoming’s trigger ban to save unborn lives.

Crago said he believes the trigger ban will be found constitutional by the Wyoming Supreme Court.

A Teton County District Court blocked the trigger ban from enforcement hours after it became law in July 2022, saying it’s undetermined whether a state Constitution provision promising Wyomingites health care autonomy reserves a right to abortion.

A trial on the trigger ban is slated for December, after which it can be appealed to the state Supreme Court.

The act has cleared the House and next will be considered by the Wyoming Senate.

The legislation would save nearly 100 unborn babies every year. Wyoming reported 91 abortions in 2020, according to the Charlotte Lozier Institute.
