And because time was short, he didn't have his robes with him, so he showed up in civilian clothes. And he did two things in the ACLU's lawsuit against Trump's invocation of the Alien Enemies Act. First, he expanded the class to include anyone deported by Trump using the Alien Enemies

Act and not just the five Venezuelans that were named in the lawsuit. And the second thing he did was he ordered all deportations to stop under the Alien Enemies Act. He halted them all. He even ordered that the two planes that were already in the air on their way to

Trump and Rubio Have Defied a Court Order

So what happens now?

As you may have heard, Judge Boasberg granted the ACLU a restraining order to halt deportations under the Alien Enemies Act and ordered planes in the air to return to the United States. Trump and Rubio have blatantly defied that order. So can they be held in contempt?

I hate to say this but the rule of law doesn’t apply to the orange cockroach. Nothing sticks. He’s never faced the consequences for his actions. Try to over throw the government? Supreme Court will give you more power. Hoard and disclose classified information? No worries, sycophant judge will dismiss the case. Commit high crimes and misdemeanors? Senate won’t convict. Now the House won’t even impeach. I am demoralized and dejected. This is worse than I ever imagined.

But speaking as a constitutional lawyer, the Supreme Court has not extended his immunity to anyone else. It might in the future but it hasn’t yet. Trump can’t do anything without the help of underlings unless he plans to do the searches, make the arrests and fly the planes himself. So everyone who does is at risk if they participate in violating a court order.

The judge needs to put teeth in his order and tell everyone involved in the deportations that they have an obligation to follow the law and court orders and start holding in civil and criminal contempt those who don’t, starting with Rubio. And if they still continue, order them jailed starting with Rubio. They may very well defy those orders and the Attorney General may well refuse to enforce them but they will at least have been exposed for what they are doing—completely blowing up and vestige of the rule of law.

Then it’s time to hit the streets en masse. We need 20 million out there to send the message and overwhelm any effort by Trump to use the Insurrection Act to stop us.

On the issue of immunity, let's look at an analogy. We know that Barak Obama ordered the assassination of Osama bin Laden. I don't think that any American would claim that Obama committed a crime , assuming there was jurisdiction. But if there were jurisdiction and if the issue arose as to whether Obama could be tried, the Supreme Court would have ruled that the assassination was ordered pursuant to the President's authority under the Constitution and therefore Obama would have been immune from prosecution. But what about the Special Forces operatives who actually pulled the trigger under orders ultimately from Obama? Could they be prosecuted and denied the right to invoke Obama's order and coverage under his immunity? I can't imagine that the Supreme Court wound deny that Obama's immunity extended to them, especially since the President frequently needs to delegate orders to his subordinates that are within his Constitutional authority.

I think that Rubio et al can invoke the same defense here if they were acting directly pursuant to Trump's orders. But this then raises the issue of whether Trump's order to Rubio to disregard the order of the Court was outside the scope of Trump's Constitutional authority (as an ultra vires act) and that Trump therefore did not have immunity, which I think is the most likely route the Court would take if it were to assert its authority under Marbury v Madison. Although the Court may not be able to enforce it, it would nevertheless carry great weight among Congress and the American people. If the Democrats controlled the House they would undoubtedly consider this grounds for an Article of Impeachment if Trump blatantly refused to obey an order of the Supreme Court on the grounds that he has the inherent right to disobey the Court.

How are undocumented people "alien enemies"? A case could be made for Bin Laden even if no state of declared war existed, but migrants? When that act was last invoked, I believe it was in order to intern Japanese Americans. Which was appalling, but at least the U.S. was at war with Japan.

Correct although only if the actions were outside the employee’s legal authority. However, if they are ordinary civil service employees and not just maga, they risk their careers even if not jail time. And finally, if federal prosecution occurs after Trump’s term and he hasn’t preemptively pardoned them, it’s too late. The employees likely will have no ironclad guarantee before they act that they will be pardoned. If I were one of them, I wouldn’t trust any promise of one.

Courts adjudicate prosecutions. Someone has to actually bring the case before the court. Who’s going to do that? Trump’s DoJ? This is a Federal matter. So a state Attorney General can only bring limited action. Probably in the form of a civil case.

As AG said. There may be a mechanism where the court of record (in this case Bosberg) charges Trump or Rubio with civil contempt and then appoints someone to enforce the action.

OMG. Me too and I'm not laughing because I'm afraid of bad karma back to me but everyday I look for a karma asteroid to wipe them out like the dinosaurs. I wake up every morning (I'm 68 and lucky I wake up) to check first thing to see if the Nazi od'd on ketamine or the Tangerine Tyrant popped off (but he deserves worse than getting off that easy. Something like locked in syndrome where he can't speak or move and has to communicate by blinking) but this is so much worse than just them. He has installed every horror in our gov't. Thiel/Vance are as dangerous. These RW Christofascists have played the long game for over 50 years until they found the perfect malevolent malignant puppet. He changed the entire world order. Everyone is terrified. I'm not going to live long enough to see if we recover. Robert Reich said it could take a decade or a generation. I am so sorry for this world being left to my young nieces and nephews. I voted for them even if their parents didn't. 😭

The court only said to pay the contractors for the work done and invoiced so even if that is done there's no future funding being released and by now the contractors have either had to look elsewhere or have had to disband. Disgusting.

The question isn't can they be held in contempt. It should be: WILL they and the entire chain of command that refuses to obey the court ruling be held in contempt? And follow it up with questions about who will enforce those contempt orders because I don't see either Bondi or Patel sending out directives to do so.

If this scenario follows the playbook (notice that I didn't say rulebook) of the corrupt SCOTUS justices who gave Trump immunity and impunity to do whatever he wants as president, then we will have a judicial branch of government that is essentially replicating what has happened in Congress: a free pass for the wealthy and those with connections to power to continue to harm us everday non-wealthy citizens.

Are we going to have wild wild west scenarios where federal judges, who do follow our Constitution and laws, will have to deputize unfairly fired federal workers like lawyers, FBI officers and civil servants to enforce those contempt orders?

I know that moving forward as a garden variety everday citizen, I will be scrutinizing and demanding public information on every candidate that is being considered for an elected or an appointed position BEFORE they are sworn into office. We as citizens should know EVERYTHING that the law allows before we give power to people who can affect our lives. And we should demand that our fellow citizens demonstrate competence and responsibly participate in the election process.

Every day I think about Benjamin Franklin's statement about whether we can keep our democracy. Well, we can't if 30% of the electorate is gullible to lies and another 30+% is either ignorant about or disenfranchised from the power of their vote.

Right now I am beginning to feel like an abused spouse in the middle of a divorce and custody battle, ignorant about my rights and trying to protect my dependents. If I have a crappy lawyer and I don't exercise my rights then I could be legally and economically destroyed. Some of our politicians are behaving like shell-shocked abused spouses instead of competent officers of the court.

So this essentially comes down to us citizens and those who hold office AND follow our Constitution. Will WE continue to allow people to be contemptuous of our Constitution and our laws OR Will WE keep our democracy?

If the representatives in my district don't do their job I might, even though I would prefer young blood to take up the challenge instead of ole retired geezers like me. At minimum I'm looking at supporting potential candidates who are not wishy washy about fighting for the rights and well-being of us average citizens. To see some of our representatives (Republican, Democrat & Independent) timidly tap dance through their responses to the hard questions being asked by their constituents nauseates me. I pray that we're not deluding overselves in an echo chamber and that there's really an upswell of citizens happening right now that are willing to hold their government to account instead of passively accepting autocratic and (in my non-legal opinion) illegal executive orders and non-action from most of Congress.

This is astounding. It certainly is going to give the Extremes pause on the idea that a "unitary executive" can, by ignoring the courts, obliterate even the judicial branch. What is terrifying is what they might hold about limits to the 5th Amendment and due process. Are they going to read "person" in the Constitution to include only "citizen?" Korematsu is easily distinguishable; dreadful as it was, there was at least a declared war.

EVEN IF he can use this to summarily deport "gang members" (which I don't think is the case) I would say that a whole lot of people are going to have causes of action for wrongful arrest and its consequences if they are NOT gang members.

Keep in mind that if a court orders CRIMINAL contempt, trump can pardon it. Not so Civil Contempt. Not clear what the differences are and how each type is applied, but I DID check out the pardon power's role.

The MAGATS will say "well deserved, they dared to be brown." But it can get much broader. Say some green card holders or even naturalized citizens from Germany protest Musk's adulation of that Nazi group. All of a sudden--"invasion" and those of German descent could find themselves in El Salvador. The Alien Enemies act allows anyone, even US citizens, of the "invader nation" punished--that's how we got the Japanese camps.

Any MAGATs out there of German descent.

One glaring omission in the Civil Rights Act. It doesn't mention political party. So trump could use this to "deport" only citizens who are descendant of the disfavored nation who are Democrats.

Once I would have thought such actions merely a basis for dystopian fiction. Not such I think so anymore.

Truly, I am ready to go. The stress and anxiety I have every day is becoming so bad that my doctor prescribed Xanax for me so I could get some sleep.

I've already had a mini stroke, and am trying to recover from that. Life just doesn't seem worth living anymore.

My family is Maga, so there wouldn't be any devastation for them when I go.

I believe they would be relieved that they didn't have to listen to me giving them the facts of what is going on in our country.

I will be 71 this year. It's been a long enough life that I've had my share of joy and sorrow. I don't care to live in a dictatorship, and it seems very likely that is where we are heading.

Took awhile, back in the 60’s, for a critical mass of opposition to form but we were patient & determined. We shall find our leaders & overcome. Meanwhile, America is learning a valuable civics lesson, about the essential nature of a good civics education.

I wish I could say I was surprised, but nothing surprises me anymore. I've been trying to educate and prepare myself for this chaos by reading Hitler's speeches, *My New Order*. There isn't anything that's currently being done by this administration that wasn't previously espoused and practiced by Hitler. It's clear to me that either Felon47 and/or the authors of Project 2025 have read it as well. It's all there...a bloodless coup; retaliation & retribution against the opposing party or anyone/anything perceived as being against him; the use of "other" as the reason for all of the country's problems; disdain for 'world' organizations and any kind of global community spirit; the tearing down of all government institutions; White Christian Nationalism; the belief that the strong have the right to do whatever they want and that a country can only thrive and grow through expansion; pressure on the press to pander to him; demanding absolute loyalty and seeing all opposing views as traitorous. I'm horrified, I'm deeply angered and sad... but not surprised.

Nothing ever comes of these court judgements that's why they carry on. The American justice system is becoming a joke unless you're a normal citizen then you're hammered.

If house arrests are beyond these judges juristricion then there are alot of people who should be released from jail etc.

Trump and his lawyers and judges won't let anything happen to them so the rule of law should be challenged by everyone in America including those facing criminal trials and demand the same treatment.

Traitor Dick, Rubio, Musk, Vought, and all the rest of the criminal Republican organization will not be held in contempt, EVER. The Judges will defer to the Supreme Court in every case. Only the Joint Chiefs are left to defend the Constitution. Lone wolf actions can't be totally ruled out. But I don't see that happening anytime soon. All American leaders are quislings to the white supremacists and christian nationalists who hijacked the nation's institutions. The oligarchs have won until uprising destroys them at least one or two generations from now.

I hope the judge moves immediately to enforce a civil contempt citation against Rubio and anyone else who should be held responsible for this rant flouting of the court’s order. Immunity only applies to the Prez for official acts- not to anyone else.

If U.S. Marshalls won't pick up Rubio like they should -- the current director was chosen by Biden, not Trump, then the judge can basically hire a posse.

To that end, I will be happy to volunteer my services. I'll even bring a bottle of water for Marco, and maybe even pour it into a sippy cup for him.

I presume that the US has a contract with the El Salvadoran prison to accept our deportees. How much are we paying for that? What is in that contract and is there any way to get the deportees out now? Is there a certain length of time that they are now to be held? Or is this a life sentence? Can the judge demand they be returned to the US? If so, what happens if the prison does not comply?

Can the judge ask the US marshals to arrest Tom Holman and if that doesn’t work because the DOJ is in Trump‘s back pocket, can those same judges deputize Washington DC police or sheriff so…?

I read two articles that say those judges can ….. think it’s about time.

The judge can issue a bench warrant for Rubio. Any law enforcement unit could then pick him up and deliver him to the judge. The judge can then put him in jail for contempt, no questions asked.

If anyone regarding this court order is actually charged with contempt, whom would be the target? Would it be the opposing counsel? Or Rubio? The court really has no choice do they? They MUST follow-up with a contempt charge for someone and it will likely become the first of many…I hope.

Good question. Unfortunately probably yes although depending on what they’re asked to do, they could also be exposed to liability under state law, which Ttump has no power to pardon. They’ll also have a scarlet letter on them for the rest of their lives.

To get a lot of things done Trump probably needs to use career government employees at some stage. I’d hope at least some would rather resign than carry out illegal orders, as several DOJ attorneys told to act illegally or unethically already have done.

Before the election is told my kids he would use this and any other tactic to deport people with or without cause and people lawfully in the US would find themselves deported to a place they had never been … but I did not think it would happen this fast. They’re already desperate to drive up the deportation data but have been told to stay away from traditionally Republican owned industries like agriculture and meat packing. In weeks, this is going to get so much uglier and do so much more damage to our economy, including to the foreign tourism industry which is beginning to tank.
