Despite the fact that marijuana is moving towards legalization in many states throughout the country, it is not legal in New York. If an individual is found to be in the unlawful possession of marijuana in New York State, they will be subject to a violation. The offender will be subject to a maximum fine of $100. Of course, this violation is only valid if the individual has 25g or less. When they are found to be in possession of more than 25g, the penalties become more serious and it is classified as a crime. The criminal consequences of unlawful possession of marijuana are as follows:
- Between 25.01 g and 2 oz: offenders may face a misdemeanor, up to 3 months of time in jail and a fine of $500
- Between 2.01 oz and 8 oz: offenders may face misdemeanor charges, up to 1 year of incarceration and a fine of up to $1,000
- Between 8.01 oz and 1 lb: offenders may face a felony charge, up to 4 years of imprisonment, and a fine of up to $5,000
- Between 1.01 and 10 lbs: offenders may face a felony charge, up to 7 years of jail time and a $5,000 fine
- More than 10 lbs: offenders may face a felony charge, up to 15 years of incarceration and a $15,000 maximum fine
