Quite often, one of the very first questions that I am asked from a prospective client is, “Do I have a personal injury case?” Whether or not there is a case requires gathering information from the potential client, learning what happened, and then evaluating what actually happened. Then I can give them an opinion sometimes right then and there as to whether or not I feel they do have a case. Sometimes there is more investigation that is necessary and after performing that investigation, I get back to the client to let them know whether or not there is something that my office can help them with. When it comes to personal injury cases, there are a lot of circumstances that need to be evaluated in order to determine whether or not you can actually bring a lawsuit in a court of law for this type of injury. Some instances will require multiple parties to take part in the case and sometimes, that might include the municipality in which you were injured.

It is also important when you are preparing to bring a lawsuit for a personal injury matter that you have all of the proof of your injury that may be required for your case. When you get injured in a public setting such as in a retail store or on a municipality owned sidewalk, it is valuable to take pictures of the surrounding areas that may have contributed to your injury so that you have definitive proof when it comes time to make your case. In some instances, a letter of prior written notice may be required and if this has not been filed, there is the chance that your case will not be successful. Every case is different and has a variety of factors that need to be investigated to determine whether or not your case is plausible.
