I am Getting a Divorce and I Have Children. Will They Have to Testify?

Many clients ask if their children are going to have to come to court to testify in a divorce. Generally speaking, that is a very rare situation where the court would want or even permit children to come testify. However, there are times when the children could be interviewed “on camera.” This is in the judge’s chambers, along with the attorney for the child appointed by the court and in the presence of a court reporter to listen to what the children have to say. However, actual testimony where the children actually sit in the witness box and actually testify under oath is very, very rare.
