Wash. Court Reinstates Mold Exposure Claims, Allows Toxicologist to Testify on Medical Causation

SEATTLE –– A Washington appellate court has reinstated mold exposure claims, finding that a toxicologist and immunotoxicologist plaintiff expert could be used to support medical causation.

In the May 27 opinion, the Washington Court of Appeals, Division I, opined that the plaintiff’s negligence claim could proceed since the proffered testimony established that mold was present in her place of employment.

Plaintiff Bonny M. Bolson filed the suit, contending that her former employer, Williams & Schloer, CPA’s, was negligent in cleaning up after a 2009 flood, allowing mold growth on the premises.
