If you received a speeding ticket, you may be tempted to pay it to avoid any more hassles—even if you know the police officer was wrong. However, that may not be in your best interest given the hefty consequences, which may include fines, possible license 
suspension, points on your driving record, and increased insurance costs. Fortunately, you may be able to use a defense that could result in your speeding ticket being dismissed or reduced.
Four Ways to Challenge a Speeding Ticket
Virginia has an absolute speeding law. This means that if you are going one mile over the posted speed limit that you are in violation of the law. However, you could fight a speeding ticket using one of these defenses:
- Attacking how your speed was determined. The police would have used a LIDAR or RADAR to determine your speed. A common defense is to challenge these tests. Each device has its own possible defenses.
- Claiming an emergency. If you can show that an emergency situation caused you to speed in order to avoid injury to yourself or another person, this could be a valid defense.
- Mistaken identity. With so many similar looking vehicles on the road, you may be able to argue that the police officer mistook your vehicle for another vehicle that was nearby at the time.
- Speedometer calibration. While getting a speedometer calibration showing your speedometer was a few mph lower than it should have been may not get the ticket dismissed, it could be a mitigating factor that could result in fewer penalties.
